Resolve disputes faster and more discreetly

In some disputes it is necessary, or may be advantageous, to take a case to arbitration. By using arbitration, you can often achieve a quicker result and, in some cases, a cheaper process.

This can be the case in construction disputes, for example. Here, the Construction Arbitration Board can take the place of the civil court, but the parties to a dispute can also set up an arbitration tribunal themselves, where the parties to the case choose and appoint one arbitrator each, after which these arbitrators appoint a chairman for the arbitration tribunal.

Once the arbitration is completed and an award has been made, it cannot be appealed. Therefore, as a party in such an arbitration case, it is essential that the arbitral tribunal is composed appropriately and that the case is thoroughly prepared and presented convincingly.

What arbitral tribunals have in common is that they must comply with the rules laid down in the Arbitration Act. Unlike judgments in civil courts, arbitration decisions are usually not published.

Not all disputes are suitable for arbitration

Arbitration is not always the right solution to disputes that arise. If the matter is fundamental, or if it is important to get a dispute right for various reasons, the case should be brought before the courts instead, with the possibility to appeal judgments or seek resolution through mediation or arbitration.
